DEFINITIONS

personal data breachmeans a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed;

GDPR: REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

special categories of personal data: personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation;

transfers of personal data: disclosing personal data to a specified third party. Transfers to EEA Member States or to bodies of the European Union shall be considered as transfers within the territory of Hungary;

data erasure:making the data unrecognisable by deletion of content or by any other means that enables an equivalent result;

10. YOUR PRIVACY RIGHTSIN HUNGARY

Right to information

You have the right to receive information prior to processing of personal data in a transparent, intelligible, clear and easily accessible form in writing from the Controller. We will provide the information latest when personal data are obtained.

Where we intend to process the personal data for a purpose other than that for which they were collected, we provide you – prior to that further processing – with information on that other purpose and other necessary information.

Right of access

You have the right to obtain confirmation from us as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and the following information:

a) the purposes of the processing;

b) the categories of personal data concerned;

c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

e) the right to request from us rectification or erasure of personal data or restriction of processing of personal data concerning you, or to object to such processing;

f) the right to lodge a complaint with a supervisory authority;

g) where the personal data are not collected from the data subject, any available information as to their source;

We provide a copy of the personal data undergoing processing. For any further copies we may charge you a reasonable fee based on administrative costs. Where you make the request by electronic means, and unless otherwise requested by you, we will provide the information in a commonly used electronic form. The right to obtain a copy will not adversely affect the rights and freedoms of others.

Right to rectification

You have the right to obtain from us – without undue delay – the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you will have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Right to erasure(’right to be forgotten’)

You have the right to obtain from us the erasure of personal data concerning you, without undue delay, and we have the obligation to erase personal data without undue delay where one of the following grounds applies:

a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

b) you withdraw your consent on which the processing is based, and there is no other legal ground for the processing;

c) you object to the processing, and there are no overriding legitimate grounds for the processing;

d) the personal data have been unlawfully processed;

e) the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which we are subject;

f) the personal data have been collected in relation to the offer of information society services.

Where we have made the personal data public and we are obliged pursuant to the points above to erase the personal data, we, taking account of available technology and the cost of implementation, will take reasonable steps, including technical measures, to inform other Controllers which are processing the personal data that you have requested the erasure by such Controllers of any links to, or copy or replication of, those personal data.

The points stated above will not apply to the extent that processing is necessary:

a) for exercising the right of freedom of expression and information;

b) for compliance with a legal obligation which requires processing by Union or Member State law to which we are subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us;

c) for reasons of public interest in the area of public health;

d) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in so far as the right to erasure is likely to render impossible or seriously impair the achievement of the objectives of that processing; or

e) for the establishment, exercise or defence of legal claims .

Right to restriction of processing

You have the right to obtain from us restriction of processing where one of the following applies:

a) the accuracy of the personal data is contested by you, for a period enabling us to verify the accuracy of the personal data;

b) the processing is unlawful and you oppose the erasure of personal data and request the restriction of their use instead;

c) we no longer need the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims; or

d) you have objected to processing, pending the verification whether the legitimate grounds of us override those of you.

When processing has been restricted in accordance with the points above, such personal data will, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

If you have obtained restriction of processing we will inform you, before the restriction of processing is lifted.

Right to notification regarding rectification or erasure of personal data or restriction of processing

You have the right to request from us information about the recipients to whom the personal data have been disclosed. We are obliged to communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you, which is based on the performance of a task carried out in the public interest or in the exercise of official authority vested in us, or for the purposes of the legitimate interest pursued by us or by a third party, including profiling based on those provisions. We will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of you or for the establishment, exercise or defence of legal claims.

Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.

Where you object to processing for direct marketing purposes, the personal data will no longer be processed for such purposes.

Right to communication of a personal data breach to the data subject

When a personal data breach is likely to result in a high risk to the rights and freedoms of you, we will communicate the personal data breach to you.

Your right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the Regulation.

The supervisory authority with which the complaint has been lodged will inform you on the progress and the outcome of the complaint including the possibility of a judicial remedy.

Right to an effective judicial remedy against a supervisory authority

Without prejudice to any other administrative or non-judicial remedy, you have the right to an effective judicial remedy against a legally binding decision of a supervisory authority concerning you.

You have the right to an effective judicial remedy where the competent supervisory authority does not handle a complaint or does not inform you within three months on the progress or outcome of the complaint lodged.

Proceedings against a supervisory authority will be brought before the courts of the Member State where the supervisory authority is established.

You may exercise these rights in writing, using our contact information provided below. We are doing our best to reply to each request as soon as possible, but within 15 workdays the latest.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the 'Shine The Light' law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services.
